Islamabad November 23 2023: The Supreme Court has upheld the decision of March 21, 2019, rejecting the plea of Bahria Town not to deposit the penalty installments.

While giving a decision on the petition filed in the Supreme Court, it has also been said that out of the total 65 billion submitted, 35 billion rupees from abroad will be given to the Sindh government, while the federal government and Bahria Town will give 30 billion rupees to the Sindh government.

The Bahria Town implementation case was heard by a three-member bench headed by Chief Justice Qazi Faiz Isa.

The court has written in its decision that the decision of the Supreme Court of March 21, 2019 was based on the consent of Bahria Town and Bahria Town had to pay PKR 460 billion in seven years.

“According to Bahria Town’s lawyer, the payments were stopped when the land was not fully received and he raised an objection to the report of the Survey of Pakistan.”

Advocate General Sindh said that Bahria Town’s own survey team was also present during the survey, the question arises whether any party can stop the implementation of the agreement which has become a court order by mutual consent. The answer is in the negative.

The court order said that ‘not filing the application for early hearing for several years was done to avoid implementation of the judgment, apparently Bahria Town is occupying more land, the real estate company did not stop payments but also occupied more land.”

In our opinion, it was not possible without the support of the concerned officers, we expect the legal action assured by the Advocate General Sindh will be implemented.

People invest lifetime savings to buy a piece of land and after spending all, people are at the mercy of the developer. It is expected that all governments will take steps to protect allottees.

In its order, the Supreme Court has also said that people have to bear the brunt of not keeping records of allotments at the government level. In the age of information technology, record keeping can be managed.

By which people can get information about the allotment themselves and keeping records at the government level will eliminate unnecessary court proceedings. Keeping records at the government level will end the practice of allotting the same plot to many people.

It is further stated in the order that ‘in the various applications on behalf of Malik Riaz Hussain, it has been stated that NAB is also investigating the matter, it will not be appropriate for this court to give observations on the matter pending in NAB. Riaz’s miscellaneous application is disposed of.”
